This paper will look at the capital punishment as it applies to cost, deterrence, and the innocence of the accused. It will discuss these issues as it applies to the overall benefit of abolishing the death penalty all together. It would also discuss and evaluate large scale violations of human rights and liberties. Capital punishment violates human rights and therefore cannot be justified for any reason. According to the Universal Declaration of Human Rights, every human has the inalienable right to life and the right not to be tortured or subjected to any cruel, inhuman or degrading punishment. The death penalty is not always smooth and painless, and therefore it is torture.

Jump to navigation Skip navigation. The American Civil Liberties Union believes the death penalty inherently violates the constitutional ban against cruel and unusual punishment and the guarantees of due process of law and of equal protection under the law. Furthermore, we believe that the state should not give itself the right to kill human beings — especially when it kills with premeditation and ceremony, in the name of the law or in the name of its people, and when it does so in an arbitrary and discriminatory fashion. Capital punishment is an intolerable denial of civil liberties and is inconsistent with the fundamental values of our democratic system. The death penalty is uncivilized in theory and unfair and inequitable in practice. Through litigation, legislation, and advocacy against this barbaric and brutal institution, we strive to prevent executions and seek the abolition of capital punishment. The death penalty system in the US is applied in an unfair and unjust manner against people, largely dependent on how much money they have, the skill of their attorneys, race of the victim and where the crime took place.

The importance of analysing the death penalty and state-imposed executions is derived from their concerning the right to life, and their retaining wide-spread support throughout retentionist, abolitionist de facto, and abolitionist states worldwide. Discrepancies in the execution rates of retentionist states appear reducible to their serving symbolic or pragmatic functions i. Prima facie, Japan seems akin to a symbolic state, due to its low execution rate and its official justification for both retaining the death penalty and continuing to use executions i. However, the practices that surround executions in Japan shroud them in secrecy and silence, which appears at odds with both its apparent symbolic function and this justification. This makes Japan a uniquely important case study for research on practices surrounding executions.
